Nicole M. Threlkel is a senior associate in the Westlake Village office of Garrett & Tully. She is a member of the Professional Malpractice and Liability team representing professional accountants and lawyers through all phases of litigation. She also represents professional clients in a transactional capacity by identifying the risks and analyzing the means and methods of mitigation created by ever evolving legislation.
Ms. Threlkel is adept at developing law-and-motion strategies to cost effectively maximize the potential of prevailing on dispositive and non-dispositive motions, while preserving the record for appeal, should an appeal become necessary. A major component of this includes researching and preparing the motions so as to highlight the essential law and facts, and anticipatorily minimize the red herrings or irrelevant analysis presented by the opposition.
Prior to joining Garrett & Tully, Ms. Threlkel focused on business and real estate litigation. For her business centric cases, she assisted clients ranging from small start-ups to large corporate entities. This involved handing their organizational formation, Intellectual Property (IP) registration, IP defense, and all of their transactional and litigation needs along the way. Her real estate practice has ranged from defending mortgage banks, servicers, and lenders from wrongful foreclosure lawsuits, enforcing and defending homeowners’ associations Covenants, Conditions, and Restrictions, and defense of real estate agents and brokers for professional negligence and malpractice claims. Her defense in many case has continued through the appellate level where she successfully opposed multiple appeals at both the state and federal level, and received an IMLA Amicus Service Award for her work on an Amicus Brief filed with the Ninth Circuit Court of Appeals.
While Ms. Threlkel’s focus has been on business and real estate litigation, her practice areas have also included the defense of municipalities, premises liability litigation, and retraining orders. She has also worked with non-profit mutual benefit corporations providing a broad range of legal and business related analysis and advice, negotiating and preparing contracts, and pursuing and defending litigation on their behalf. Ms. Threlkel also offers her time and expertise to local groups to educate them on business strategies that can help them avoid future litigation.
